USER AGREEMENT

This User Agreement ("Agreement") between you and BYG Events and Sports, co-powered by GTF Solutions, governs your use of the Website at www.revolutionruns.com and any related event, community, chat or mail services (together, the "Services"). Your use of the Services in any manner, including browsing the Website, registering for an event, or using any community feature, constitutes your acknowledgement that you have read, understood and agreed to be bound by this Agreement.

BYG Events and Sports may offer event registration through the Website. To register you must provide accurate and complete information and maintain and promptly update your details. You are responsible for the authenticity of the information you provide. BYG Events and Sports may require additional verification for certain categories such as minors, timed categories or corporate teams, and reserves the right to refuse registration at its sole discretion.

BYG Events and Sports may amend or update this Agreement at any time. Any modifications shall be effective immediately upon posting on the Website. Your continued use of the Services after any such change constitutes your acceptance of the revised Agreement. It is your responsibility to review this page periodically to stay aware of any changes.

Registration for events may involve the payment of applicable entry fees. All fees are payable in Indian Rupees through the payment methods indicated on the Website. Fees, except where stated otherwise, are non-refundable. BYG Events and Sports may, from time to time, introduce, revise or withdraw charges for any service, and any such changes will be notified through the Website.

The content on the Website, including text, graphics, logos, images, audio, video, software and its compilation (the "Content"), is the property of BYG Events and Sports, its licensors or its content providers and is protected by Indian and international copyright, trademark and other intellectual property laws. The trademarks, logos and service marks displayed on the Website are registered and unregistered marks of BYG Events and Sports and others.

You are granted a limited, revocable, non-exclusive, non-transferable permission to view, copy, print and distribute the Content from this Website solely for personal, non-commercial, informational purposes, provided that you retain all copyright, trademark and other proprietary notices. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, incorporate into another website or use the Content in any way for commercial or public purposes without the prior written permission of BYG Events and Sports.

Access to certain Services may require an account or individual registration. You agree to provide true, accurate, current and complete information and to update it when necessary. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify BYG Events and Sports immediately of any unauthorized use of your account. Any exchange of information through the Services is at your own risk, and you agree not to share sensitive personal information publicly.

As a condition of your use of the Services, you warrant that you will not use the Services for any purpose that is unlawful or prohibited by this Agreement or Any Applicable Law, rule, regulation, guideline or order of any governmental or regulatory authority in India. You may not use the Services, or any part of them, in any manner that could damage, disable, overburden or impair any BYG server, network or the Services themselves, or interfere with any other party's use of the Services.

BYG Events and Sports does not claim ownership of material you transmit, upload, post, email or otherwise make available through the Services. However, by posting, uploading, inputting, providing or submitting material, you grant BYG Events and Sports a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, copy, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such material in any media, subject to applicable privacy law. You represent and warrant that you own or otherwise control all rights to such material and that its publication does not violate the rights of any third party.

The Website may offer chat rooms, message boards, community forums, social features or similar Community Services. You agree that by using the facility of chat or any other community service, you will not post, transmit, display or otherwise communicate any content that is unlawful, defamatory, obscene, invasive of another's privacy, or that harasses or is abusive to any person or entity. BYG Events and Sports reserves the right, but does not have the obligation, to monitor communications and to edit, refuse to post or remove any material, in whole or in part, that in its sole discretion it deems objectionable or in violation of this Agreement.

You agree not to use the Services to: (a) upload, post or transmit any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, invasive of privacy, hateful or racially, ethnically or otherwise objectionable; (b) impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity; (c) forge headers or otherwise manipulate identifiers to disguise the origin of any material; (d) download, transmit or otherwise make available any material that infringes the intellectual property rights of any party, or any file that contains viruses or other harmful components; (e) engage in unsolicited mass mailing, spamming, flooding or chain mail; or (f) harvest or collect information about other users, including email addresses, without their consent.

Participant Safety, Assumption of Risk, Waiver, Release, Indemnity, Injury and Death

You agree to indemnify, defend and hold harmless BYG Events and Sports, its co-powers, affiliates, officers, directors, employees, agents, volunteers and representatives from and against any and all claims, damages, losses, liabilities, costs and expenses, including reasonable attorney's fees, arising out of or in connection with your use of the Services, your violation of this Agreement, or your participation in any event organized by BYG Events and Sports.

Participation in any event, race, run, sports activity, training or related activity involves inherent risks, which may include physical injury, serious injury, and, in rare cases, permanent disability or death. You acknowledge and voluntarily assume all such risks, known and unknown, and agree that your participation is entirely at your own risk.

To the maximum extent permitted by applicable law, you release and agree not to hold BYG Events and Sports, its sponsors, partners, venue owners, officials, volunteers and agents responsible for any injury, loss or damage suffered by you arising out of or in connection with your participation, including injury to persons or damage to property, caused by the condition of the routes, venue, equipment, facilities, weather, or the negligence, whether active or passive, of the released parties.

Where a participant is below eighteen (18) years of age, the parent or legal guardian registering the participant acknowledges that they have read this Agreement, consent to the participation of the minor, and agree, on behalf of themselves and the minor, to all the terms, releases, waivers and indemnities contained in this Agreement. Participants are strongly encouraged to maintain appropriate personal accident, health or medical insurance while participating in any event.

To the maximum extent permitted by law, in no event shall BYG Events and Sports, its directors, employees, agents, co-powers or content providers be liable for any indirect, incidental, special, consequential or punitive damages, or for any damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information), arising out of the use of or inability to use the Services, even if BYG Events and Sports has been advised of the possibility of such damages. BYG Events and Sports's total liability to you for all claims, in aggregate, shall not exceed the amount paid by you, if any, for access to or use of the Services during the twelve (12) months preceding the claim.

BYG Events and Sports may, in its sole discretion, terminate your access to the Services or any part of them, suspend or block your account, or remove and discard any content within the Services, at any time, with or without notice, for any reason, including without limitation breach of this Agreement. BYG Events and Sports may also in its sole discretion and at any time discontinue the Services, or any part of them, with or without notice. Upon termination, your right to use the Services ceases immediately, and you agree that BYG Events and Sports shall not be liable to you or any third party for any such termination.

You agree to comply with all laws, rules and regulations applicable to your use of the Services and to act reasonably and honestly in all your dealings with BYG Events and Sports and other users. You shall not engage in any conduct that restricts or inhibits any other user from using or enjoying the Services, and you shall not use the Services to advertise or offer to sell or buy any goods or services for any business purpose, unless expressly permitted. You are solely responsible for the quality, accuracy and legality of the content you submit and for any consequences arising from such submissions.

BYG Events and Sports does not permit unsolicited commercial e-mails or spam. You agree not to send, cause to be sent, or authorize the sending of any unsolicited bulk or commercial messages through the Services or in connection with any event or community activity organized, listed or promoted by BYG Events and Sports. BYG Events and Sports reserves the right to take appropriate action, including blocking, suspending or terminating offending accounts and pursuing legal remedies, against any person or entity found to be engaged in such activity.

Where the Services include electronic mail, newsletter or messaging features, you agree to use them solely for legitimate communications related to BYG Events and Sports activities. You shall not use such services to transmit unlawful, harassing, defamatory or obscene material, and you shall not use them to gain unauthorized access to any computer or network. BYG Events and Sports may periodically send you communications, including event updates, results and promotional material; you may opt out of marketing communications at any time by following the instructions provided in such communications or by contacting our team.

THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY. BYG EVENTS AND SPORTS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK.

The Website may contain links to third-party websites that are not owned or controlled by BYG Events and Sports. BYG Events and Sports has no control over, and assumes no responsibility for, the content, privacy policies or practices of any such websites. You acknowledge and agree that BYG Events and Sports shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods or services available on or through any such third-party website. We encourage you to review the terms and privacy policies applicable to any third-party site you visit.

Other users may submit material to the Services. BYG Events and Sports does not control, monitor or endorse such material and does not guarantee its accuracy, integrity or quality. You understand that by using the Services you may be exposed to material that is offensive, indecent or objectionable. BYG Events and Sports shall not be responsible in any manner for such material, and you are solely responsible for your reliance on and use of any user-submitted material.

Any advertising or promotional material displayed on the Website does not constitute an endorsement or recommendation by BYG Events and Sports of the advertised product, service or entity. BYG Events and Sports is not responsible for the content, accuracy or availability of any advertising material on the Website, and any dealings you have with advertisers found on or through the Services, including payment and delivery of goods or services, are solely between you and the advertiser.

Your privacy is important to us. Any personal information that you provide to BYG Events and Sports is collected, stored and processed in accordance with applicable data protection law in India, including the Digital Personal Data Protection Act, 2023, and our Privacy Policy. By using the Services you consent to the collection, use and disclosure of your information as described in our Privacy Policy. BYG Events and Sports implements reasonable technical and organisational measures to protect your information and does not sell your personal data.

Nothing in this Agreement shall be deemed to create a partnership, joint venture, principal-agent, franchise or employment relationship between you and BYG Events and Sports. You agree that no joint venture, partnership or employment relationship exists as a result of this Agreement or your use of the Services. BYG Events and Sports is an independent organiser of events and sports activities, co-powered by GTF Solutions for technology and related services.

BYG Events and Sports shall not be liable for any failure or delay in performance of its obligations under this Agreement or in connection with any event or service, where such failure or delay results from any event or circumstance beyond its reasonable control, including without limitation act of God, earthquake, flood, storm, fire, war, terrorism, civil disturbance, epidemic, pandemic, governmental action, curfew, regulatory orders or failure of public infrastructure and utilities. In such circumstances, scheduled events may be postponed, rescheduled or cancelled, and BYG Events and Sports shall endeavour to notify participants and, where applicable, adjust entries in line with applicable policy.

This Agreement shall be governed by and construed in accordance with the laws of the Republic of India. Subject to the arbitration clause, if any, the courts of competent jurisdiction at Bengaluru (Bangalore), Karnataka, India shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement and your use of the Services.

This Agreement, together with the Privacy Policy and any other policy, schedule or annexure referenced herein, constitutes the entire agreement between you and BYG Events and Sports with respect to the Services and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and BYG Events and Sports with respect to the Services. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Any claim or cause of action arising out of or related to your use of the Services or this Agreement must be commenced within one (1) year after such claim or cause of action accrues; otherwise, such claim or cause of action is permanently barred, to the maximum extent permitted by applicable law.

Your use of the Services constitutes your acceptance of our Privacy Policy, which is available on the Website and forms an integral part of this Agreement. If you do not agree to the terms of our Privacy Policy, please discontinue the use of the Services.

If any provision of this Agreement is held to be unenforceable or invalid, such provision shall be limited or eliminated to the minimum extent necessary so that the Agreement shall otherwise remain in full force and effect. This Agreement is personal to you and may not be assigned, transferred or sublicensed by you without the prior written consent of BYG Events and Sports. The failure of BYG Events and Sports to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Headings are for reference purposes only and do not limit or affect the meaning of any provision.

If you believe that any content on the Website infringes your copyright, you may provide BYG Events and Sports with a written notice of copyright infringement containing: (a) a physical or electronic signature of the person authorised to act on behalf of the owner of the copyright; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material; (d) your contact information; (e) a statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.
